Jay L. Dolgin

Principal, Estate and Tax Lawyer, also practicing Corporate Law

Born in Chicago, Jay graduated from the University of Wisconsin-Madison with a Bachelor of Science Degree and received his Juris Doctor Degree from DePaul University. He was admitted to the Illinois bar, the Florida Bar, the Texas Bar, the U. S. Court, Northern District and the U. S. Tax Court. Jay‘s professional memberships include the American Bar Association, Illinois State, Florida State and Texas State Bar Associations and the Chicago Bar Association. He has also been an Adjunct Professor of Law at John Marshall Law School where he taught estate planning, will drafting, and trusts and estates. His practice focuses on areas of estate and tax planning, asset protection, general probate, deceased estates, guardianships and trust administration; general corporate, including business planning, business transactions and succession planning.

Jay Dolgin has practiced estate and tax planning and more for many years in Chicago, Florida and now in Texas. He has represented closely-held family businesses including professional business corporations including attorneys, accountants, architects, engineers, medical service corporations, manufacturing, distributing, restaurants, food distributors, professional service corporations, and retail.

Complex Family Tax Situations:

Jay has handled many complex family situations where children and parents/step-parents have adverse interests that were resolved without need of court intervention.

In addition to creative tax planning helping families transfer substantial value to their children at little or no gift tax cost, Jay has been especially successful in mediating complex family relationships pre- and post-death.

Jay has also successfully handled many estate tax audits but is particularly proud of having created the strategy wherein a decedent’s estate owned 50% of a closely held business having $37,000,000 in cash, was valued at $7,000,000 and settled with the IRS for $8,000,000 value.

Estate and Gift Tax Planning

Dolgin Law Group has a vast array of planning techniques and tools that can be implemented for individuals and families. From the simple Will, which allows a person to choose his or her Executor to administer his or her estate, to the Guardian to take custody of his or her children and/or disabled adults, to very complex plans including Marital Deduction Planning, Generation-Skipping and asset protection and much more.  There is an estate plan for every person and family, and depending on individual needs, we offer alternatives and solutions to suit you best.

Our Expertise Includes:

Gift and estate tax planning, drafting and execution of Wills, Trust (revocable and irrevocable) i.e. declarations of trust, defective Grantor Trusts, Generation-Skipping and Dynasty Trusts, Minor’s Trusts, GRATS, GRUTS, CRATS, CRUTS, Health Care and Property Powers of Attorney. There is literally an "alphabet soup" of options available to our Estate Planning clients.

To provide for asset protection some of our solutions may include Discretionary Trusts or separately created entities including Family Limited Partnerships as well as Foreign Trusts.

We are also intimately involved in Estate and Trust Administration including all aspects related to decedent’s estates, Trust and Probate Administration, preparation of Gift and Estate Tax Returns, including valuation discounts and other tax planning techniques; managing Estate and Trust Administration, including preparation of accountings and fiduciary income tax returns; post mortem planning including qualified disclaimers fiduciary income tax elections, payment of decedent’s bills and expenses of administration; and the distribution of decedent’s estate, including the funding of any Trust required and finally the planning and administration of estates for minors and disabled adults.

The creation and implementation of Family Foundations has become a major planning device for persons with large IRA account balances, qualified plan benefits and other substantial deferred compensation assets. It provides a means to fund charitable intentions, reduce estate tax and income tax consequences and provide families with the means to carry out charitable intentions.

Our solutions also include succession planning for family businesses, including shareholder freezes, sales to defective Grantor’s Trusts and the transfer of business interests via Grantor Retained Annuity Trusts (GRAT).
